Skilled Worker Visa
The Tier 2 category permits businesses in the UK to employ workers from outside the European Economic Area (EEA). A business must first have a sponsorship licence granted to it from the UKBA.
SBA Solicitors have assisted hundreds of businesses to obtain a licence, undertaken pre audit compliance checks, challenged civil penalties and also conducted appeals to assist our corporate immigration clients. After the 1 January 2021, and the end of free movement, then whether you are from a non-EEA country or you are an EU citizen you will need a visa to enter the UK to live and work. The notable exception to this requirement is if you are from the EU and you enter the UK prior to the 31 December 2020 and apply for pre-settled status under the EU Settlement Scheme by the cut-off date. For non-EEA nationals, used to the UK visa process, the new skilled worker visa may come as a welcome change as there are some positives in comparison to the current Tier 2 (General) visa. However, for EU citizens looking to settle in the UK after the 1 January 2021, and for UK employers used to employing EU nationals without red tape or hassle, the proposed new skilled worker visa may take some getting used to.
To be eligible you must score a minimum of:
§ 50 points – Attributes, including having a sponsor with a valid Certificate of Sponsorship;
§ 10 points – English language skills (except for Intra-Company Transfer);
§ 10 point – Maintenance, which is your available funds.
Your case is also considered in line with the General Grounds for Refusal criteria.
You can be eligible for a Tier 2 Visa if you:
§ Have a job offer from a UK-based company
§ Hold a Certificate of Sponsorship (CoS) issued by a licensed sponsor
§ Will be earning an appropriate salary for the job
§ Meet specific English language requirements
§ Are over the age of 16 on the date of your application
§ Meet the maintenance requirements and can support yourself and your family without relying on public funds.
